Under the 2008 Act, a person must be licensed as an agent, branch manager or salesperson if they perform 'real estate agency work'. Real estate agency work does not include most property management services, such as arranging maintenance or repairs of properties or providing letting services in relation to properties that are governed by the Residential Tenancies Act 1986. This means that a person does not need to be licensed under the 2008 Act to provide these services. However, currently under the Residential Tenancies Act 1986 only property managers who are real estate agents may charge a letting fee to the tenant
Real estate agency work does include letting services in respect of property not governed by the Residential Tenancies Act 1986, such as commercial property.
