You can object to the issue of a licence (section 40 of the Real Estate Agents Act 2008).

(2) No objection may be made under subsection (1) except on one or more of the following grounds:

    • (a) that the applicant is not eligible to obtain a licence by virtue of section 36 or 37:

    • (b) if the applicant is a company, that any person who will be an officer of the company if the application is granted is not, by reason of his or her personal character or financial position, a proper person to be an officer of a licensee company.

(3) The notice of objection must include a statement of the grounds relied on and any prescribed matters.

What happens once I have sent in my objection?

  • For your objection to be processed, we must have received a licence application from the person you are objecting to. If no application has been received from the person concerned, your objection will be held until an application is received.
  • A copy of your objection will be sent to the licence applicant.
  • The licence applicant will have the opportunity to respond to the Registrar, in writing, regarding the objection.
  • If the licence applicant does respond, a copy of the response will be sent to you and you can make further comment if you want to.
  • The Registrar will hold a hearing to consider the evidence (after giving at least 14 days’ notice to the licence applicant and any objector/s).
  • Once the Registrar has made a decision on the eligibility of the licence applicant to hold a licence, the applicant and the objector/s will be advised of the outcome.
