Disciplinary Tribunal Decisions

The Real Estate Agents Disciplinary Tribunal (the Tribunal) is an independent body that is administered by the Ministry of Justice.  The Tribunal is separate to the Real Estate Agents Authority.

The Tribunal will consider any charges laid before it by a Complaints Assessment Committee (CAC). It will also hear appeals on decisions made by a CAC and on application can review licensing decisions of the Registrar.

The Tribunal's decisions of misconduct are listed below.

    Decision:  Guilty of misconduct
    Penalty:  Both defendants censured and ordered to pay a fine of $600 each.

    Licence Number:  Because the licensee's licence has been cancelled they no longer have a licence number or show on the Public Register.

    Decision:  Guilty of misconduct
    Penalty:  Order that the licensee's licence be cancelled and that she pay a fine of $750.  As the conduct occurred before the commencement of the Real Estate Agents Act 2008, orders were limited to those that were availalbe under the Real Estate Agents Act 1976.

    Penalty:  Order that the licensee's licence be suspended for six months (effective one month from the 27 May 2011).

    Penalty:  Order that the licensee's licence be cancelled.  No further orders were able to be made due to the conduct occurring before the commencement of the Real Estate Agents Act 2008.

    Decision:  Guilty of misconduct
    Penalty:  The Tribunal found that had the defendant not been in liquidation and ceased trading it would have made an order under section 110(2)(b) of the Act cancelling its licence.
