​C05087​ ​​​The licensee was the selling agent for the appellant and his ex-partner, who were both parties to relationship property proceedings in the Family Court. The licensee provided an affidavit to the Family Court on behalf of the ex-partner without consulting the appellant. The Tribunal said that when acting for two opposing parties in a real estate transaction, a licensee should ensure (and record) that each party is aware of every action that is being taken. The licensee should if possible get the approval of both parties. This, the licensee failed to do and so breached Rules 5.1, 6.1, 6.2, 6.4 and 9.1 and was guilty of unsatisfactory conduct under sections 72(a) and (b) of the Act​. Reprimand / Reprimand
